Remodeling the Premises under Grandfather Protection without an Active, Conditional Use Permit "CUP".

When retaining Penthouse Advisors INC., filing an ABC 255 Zoning affidavit with a Los Angeles County Plan-Check is mandatory. This will confirm, the Conditional Use Beverage Permit will Not be Required at the Said Location. The affidavit is then delivered to the Restaurant/Bar Owner in the event verification is required.

Grandfather Protection Meaning: Any Restaurant or Bar opened many years ago in code compliance during its opening, will not be required to bring the premises up to current code, as long as the following rules are followed.

“Grandfather” Remodel Restrictions: The “floor plan” of the Restaurant or Bar (the premise) can not be altered in any way, with the exception of redecorating and or changing equipment. Building permits are forbidden to be pulled that will change the historic floor plan. When this rule is broken the Grandfather Code Protection expires closing the Business until the currant code compliance is inspected and approved.

Penthouse Advisors INC., is offering Fast, Cannabis License processing and Expediting inside Open, Permitted Restaurants creating “Dispensary Cafe’s” now that California Dispensaries are finally under the AB1775 New Ruling with a Start Date of January 1, 2025. This ruling will allow Dispensaries to build kitchens and dining areas inside their leased premises to serve food under one ticket and one entity.

The New Trend. “Smoke Marijuana inside your CA., Dispensary, Restaurant/Cafe, before, during and after, dining”. AB1775 CA., Ruling with a Start Date of January 1, 2025

  1. First Step, Fast Cannabis License Expediting: Upon Property Owner approval of the Application to obtain a Commercial Cannabis License for the Premises the application process will commence. The City of Los Angeles, Office of Finance must issue a Business Tax Registration Certificate (BTRC) “account number” to start the process. Followed by the Legal Business Entity Record submitted through the DCR Licensing Portal, etc.
  2. Termination: If and when the Applicant loses site control of its proposed Business Premises, including, but not limited to, termination of the commercial lease, or termination of the right to occupy the Business Premises, “i.e.” rent default, etc., the Tenant/Licensee shall submit a Business Premises Surrender Form (LIC-4019-FORM) within ten (10) days of losing site control.
  3. Engage: Licensees shall engage only in the Commercial Cannabis Activity(ies) for
    which a License has been issued and only at the Business Premises location for that
    License.
  4. Operating Permit: A Licensee that conducts Commercial Cannabis Activity without an
    Operating Permit or Temporary Approval for the relevant Commercial Cannabis Activity
    is an Unlawful Establishment.
  5. Emblem Placard: If the Licensee is engaged in Storefront Retailer or Microbusiness Commercial Cannabis Activity with on-site sales, the Licensee shall obtain an Emblem Placard as required in LAMC Section 104.23.
  6. Special events: DCR shall not issue Licenses or other authorization for temporary or special events in the City of Los Angeles.
  7. Relocating: If the relocation modification request is approved after an Annual License is issued, the Licensee shall complete the Final Inspection process to receive an Operating Permit at the new Business Premises location. Licensees with an active corresponding State License may request Temporary Approval for the new Business Premises through the DCR Licensing Portal prior to completing the Final Inspection. An Initial Inspection of the Business Premises, conducted by DCR, is required prior to the issuance of Temporary Approval, subject to the payment of any required fee(s) pursuant to LAMC Section 104.19.
